New MoU to Promote Alternative Dispute Resolution Methods in the UAE

In line with ongoing efforts to solidify Dubai's status as a leading global hub for resolving commercial disputes, Dubai Courts signed a Memorandum of Understanding (MoU) with Dubai Chambers on September 26, 2024. This agreement aims to bolster collaboration in the field of alternative dispute resolution methods.  This initiative is a key component of Dubai's strategic plan to enhance its position as a prominent destination for amicable and efficient commercial dispute resolution, fostering a supportive business environment and attracting investments.  

Objectives of the MoU

The MoU primarily focuses on promoting mediation and conciliation services as alternatives to traditional litigation, offering faster and more cost-effective solutions compared to protracted legal proceedings.  Through this partnership with Dubai Chambers, Dubai Courts seeks to develop a comprehensive system for commercial dispute resolution. This will enhance trust among disputing parties and encourage the use of alternative solutions, saving time, effort, and ensuring confidentiality and efficiency.  

Key Provisions of the MoU

A significant provision in the MoU grants enforceability to agreements reached through mediation and conciliation, backed by Dubai Courts' endorsement.  Any settlement reached between parties through these alternative methods will become legally binding upon registration in Dubai Courts' electronic system.  The MoU also facilitates the easy registration of agreements via the electronic system, enhancing efficiency and expediting procedures.
