Arbitration is the preferred method of dispute resolution for major commercial contracts in the UAE and the wider Gulf region. Construction contracts, trade agreements, joint ventures, franchise arrangements, financial instruments and real estate development agreements routinely contain arbitration clauses referring disputes to DIAC, ICC, LCIA, DIFC-LCIA or other internationally recognised institutions. We approach each arbitration with rigorous preparation — analysing the contract, the procedural history, and the factual record before developing a case theory that is clear, compelling and adapted to the specific panel. We draft detailed Statements of Claim and Defence, manage the document disclosure process efficiently, prepare witnesses thoroughly, and deliver focused and persuasive oral submissions. We have extensive experience appearing before senior commercial arbitrators from international and UAE backgrounds.

Construction Arbitration

Construction disputes account for a significant proportion of UAE arbitrations — particularly in Dubai's active development market. We handle FIDIC-based construction arbitrations, delay and disruption claims, variation disputes, subcontractor claims and termination of contract disputes. Our team includes lawyers with specialist construction law training and experience working alongside leading quantum experts and delay analysts.

Emergency Arbitration and Interim Relief

Where urgent interim relief is needed before or during arbitration proceedings — asset freezing, injunctions preventing specific actions, or preservation of evidence — we pursue both emergency arbitrator applications and parallel court applications for supportive measures. Court litigation is decided by a state judge applying UAE civil procedure rules in Arabic. Arbitration is decided by a privately appointed tribunal applying the parties' agreed procedure, often in English. Arbitration offers: confidentiality, choice of tribunal, procedural flexibility, and an award that is internationally enforceable under the New York Convention — often making it preferable for international commercial disputes.
If the contract contains a mandatory arbitration clause, the court will generally refer parties to arbitration. The clause must specify the arbitration institution or rules, the seat of arbitration and (often) the language and governing law. If the clause is poorly drafted, disputes may arise about its validity and scope — we advise on both enforcing and challenging arbitration clauses.
DIAC arbitrations targeting simple commercial disputes can conclude in 12–18 months from the notice of arbitration to final award. Complex multi-party construction or investment disputes may take 2–4 years. ICC proceedings have mandatory timelines (draft award within 6 months of closure of proceedings) but overall duration depends heavily on complexity and party cooperation. We advise on realistic timelines for your specific dispute.
Arbitral awards cannot be appealed on the merits — that is a fundamental feature of arbitration's finality. Awards can only be set aside (annulled) by the supervisory court at the seat of arbitration on very limited grounds: procedural defects, excess of jurisdiction, breach of public policy or invalidity of the arbitration agreement. Setting aside is rare and difficult. We advise on whether grounds for challenge exist.
Act immediately. Strict deadlines apply for filing a Response to the Notice of Arbitration, nominating your arbitrator, and raising any preliminary objections.
